Terms of use

1. Who this is between

“DateSMP”, “we” and “us” mean the operator named on the legal information page. “You” means the person using the service. Using DateSMP means you accept these terms; if you do not, do not use it.

2. What DateSMP is

A dating service for adults that arranges dates inside Minecraft. You match with somebody, agree a time, and a private Minecraft world opens for the two of you with activities in it. Using it costs nothing today: creating an account, matching, planning a date and playing one require no payment. Nothing about who you meet is for sale.

DateSMP is not affiliated with, endorsed by or associated with Mojang AB or Microsoft. You need your own lawful copy of Minecraft, and Mojang's own terms apply to your use of it.

3. You must be 18

DateSMP is strictly 18+. By using it you confirm you are at least eighteen and that the date of birth you gave is your real one. We take reports about underage accounts seriously: an account reported as belonging to a minor is locked while it is reviewed, and a confirmed one is closed and deleted.

You must also not be barred from using a service like this under the law where you live, and not have had a DateSMP account closed for breaking these terms before.

4. Your account

• One account per person. It is yours; do not share it or let anybody else use it.
• Sign-in is a link sent to your email. Anybody with access to that inbox can get into your account, so keep it secure.
• Everything on your profile must be true and yours. Photographs must be of you, and you must have the right to use them.
• Linking a Minecraft account proves you control that character. Do not link somebody else's.

5. How to behave

The community guidelines are part of these terms and set out what is and is not acceptable. In summary: treat other people as people, take no for an answer, and do not use DateSMP to harm anybody.

You also agree not to:

• Impersonate anybody, or misrepresent your age, identity or intentions.
• Use DateSMP commercially: no advertising, recruiting, promotion or selling of anything.
• Scrape, automate, reverse engineer, or attempt to access accounts, servers or data that are not yours.
• Record, screenshot or redistribute another member's private conversation, voice or photographs outside DateSMP.
• Grief, exploit or attack the Minecraft servers, or interfere with anybody else's date.

6. What you write and upload

Your photographs, messages and profile stay yours. You give us only the permission needed to run the service, to store your content, show it to the people you are matched with or discoverable by, and process it to make DateSMP work. That permission ends when you delete the content or your account, except where we are required to keep something for safety or law.

We do not read private conversations except when a report or a legal obligation requires it, and we do not use anything you write to train models.

7. Reporting, and what we do about it

Any member can be reported from their profile, from a conversation, from a date or from the blocked list. A person reads every report, and depending on what we find we may do nothing, warn, restrict what an account can do, lock it while we look, or close it.

Two things happen before anybody has read anything. An account reported as underage by several different people is locked automatically while we check, and an account that tells us it belongs to somebody under 18 is locked the moment it says so. Both are holds rather than decisions: a person still reviews them, and you can ask for that review at safety@datesmp.com.

If we restrict or close your account we will tell you what rule was broken and, where it is possible without endangering somebody, what the evidence was. You can reply to that decision by writing to safety@datesmp.com, and a person will look again. We keep the right to act immediately and explain afterwards where somebody is at risk.

8. Donations

Donating is optional and buys nothing. There is no badge, no tier and no donor reward, and it has no effect on who you are shown or who is shown you. The donations and refunds policy sets out the rest.

9. What we do not promise

DateSMP is provided as it is. We do not promise that it will always be available, that a Minecraft server will always start, that you will match with anybody, or that anybody you meet is who they say they are. We do not verify identity. Use the same judgement you would use meeting a stranger anywhere else. The safety centre has the practical version.

We may change, suspend or discontinue any part of the service. Where a change is significant we will give notice in the app.

10. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under Dutch law. Nothing here removes the rights you have as a consumer.

Beyond that, and because DateSMP is provided free of charge, we are not liable for indirect or consequential loss, for lost data, or for what another member does. Our total liability to you is limited to fifty euros or the amount you have donated in the previous twelve months, whichever is greater.

11. Ending it

You

Delete your account whenever you like, from Account → Delete account. It takes effect immediately, and there is no subscription to cancel: the service is free to use.

Us

We may suspend or close an account that breaks these terms or the guidelines, that we reasonably believe belongs to somebody under 18, or where keeping it open would put somebody at risk. Where it is safe and reasonable to do so, we will warn first.

12. Law and disputes

Dutch law governs these terms. Disputes go to the courts of the Netherlands, except where consumer law entitles you to bring a claim where you live. If a clause here turns out to be unenforceable, the rest still stands.

13. Changes

We will tell you in the app before a material change takes effect. Carrying on using DateSMP after that is how you accept it; if you would rather not, delete your account.
